Important: Please read these Terms of Use carefully before using our navigation platform. By accessing or using GPS Live Navigate, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and GPS Live Navigate ("we," "us," or "our") regarding your use of our navigation platform, website, and related resources (collectively, the "Platform").

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least 16 years of age to use our Platform. By using the Platform, you represent and warrant that:

  • You are at least 16 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws
  • All information you provide is accurate and current

3. Platform Description and Use

3.1 Navigation Features

GPS Live Navigate provides real-time navigation, route planning, traffic updates, and related location-based resources. Our Platform is designed to assist with navigation but should not be your sole means of direction.

3.2 Permitted Use

You may use the Platform for personal, non-commercial navigation purposes. You agree to use the Platform in accordance with these Terms and all applicable laws and regulations.

3.3 Prohibited Uses

You agree NOT to:

  • Use the Platform for any illegal or unauthorized purpose
  • Interfere with or disrupt the Platform's operation
  • Attempt to gain unauthorized access to any portion of the Platform
  • Use automated systems to access the Platform without permission
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Remove, alter, or obscure any proprietary notices
  • Use the Platform to transmit harmful code or malware
  • Impersonate any person or entity
  • Harvest or collect information about other users
  • Use the Platform in any way that could damage our reputation

4. User Responsibilities

4.1 Safe Usage

When using our navigation Platform while driving or operating a vehicle, you must:

  • Always obey traffic laws and road signs
  • Keep your primary attention on the road
  • Use hands-free features when available
  • Pull over safely if you need to interact with the Platform
  • Never rely solely on the Platform for navigation decisions
  • Verify route information and road conditions independently

4.2 Account Security

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and current

5. Location Data and Accuracy

5.1 Location Information

The Platform relies on location data, which may be provided by GPS, cell towers, WiFi hotspots, or other sources. Location accuracy can vary and may be affected by various factors including weather, terrain, and device capabilities.

5.2 No Guarantee of Accuracy

While we strive to provide accurate navigation information, we do not guarantee:

  • The accuracy, completeness, or timeliness of map data
  • The availability or accuracy of traffic information
  • That routes suggested are the fastest or most efficient
  • That all roads, POIs, or features are correctly represented

5.3 User Discretion Required

You acknowledge that navigation data is for informational purposes only and that you must use your own judgment when following directions. Always verify road conditions, closures, and restrictions independently.

6. Intellectual Property Rights

6.1 Our Rights

The Platform and all its content, features, and functionality are owned by GPS Live Navigate and are protected by international copyright, trademark, and other intellectual property laws. This includes but is not limited to:

  • Software and source code
  • Design, layout, and look-and-feel
  • Text, graphics, logos, and images
  • Data compilations and algorithms
  • Trademarks and brand elements

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms.

6.3 Third-Party Content

Map data and certain other content are provided by third-party licensors and are subject to their respective terms and conditions.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, reliability, or completeness
  • Warranties of uninterrupted or error-free operation
  • Warranties that defects will be corrected
  • Warranties regarding security or freedom from harmful components

Your use of the Platform is at your sole risk. We do not warrant that the Platform will meet your requirements or expectations.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPS LIVE NAVIGATE SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Personal injury or property damage
  • Accidents, delays, or route inefficiencies
  • Reliance on navigation information provided by the Platform
  • Interruptions or errors in Platform operation

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless GPS Live Navigate, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations
  • Any content you submit or transmit through the Platform

10. Third-Party Resources and Links

The Platform may contain links to third-party websites, resources, or map data providers. We do not endorse and are not responsible for:

  • The availability or accuracy of third-party content
  • The privacy practices of third-party sites
  • Any harm resulting from your use of third-party resources

Your interactions with third parties are solely between you and such third parties.

11. Modifications to the Platform

We reserve the right to:

  • Modify, suspend, or discontinue the Platform at any time
  • Change features, functionality, or availability
  • Update map data, traffic information, or algorithms
  • Impose limits on certain features or access

We are not liable for any modification, suspension, or discontinuation of the Platform or any part thereof.

12. Changes to Terms

We may revise these Terms at any time by updating this page. Changes become effective when posted unless otherwise stated. Material changes will be communicated through the Platform or by email.

Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform.

13. Termination

13.1 Termination by You

You may stop using the Platform at any time. If you have an account, you may request account deletion by contacting us.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Suspected fraudulent or illegal activity
  • Extended periods of inactivity
  • Technical or security reasons

13.3 Effect of Termination

Upon termination, your right to use the Platform immediately ceases. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

14. Geographic Restrictions

The Platform is designed for use worldwide, but we make no representation that it is appropriate or available for use in all locations. Access may be prohibited from certain jurisdictions, and you are responsible for compliance with local laws.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

15.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.

15.3 Informal Resolution

Before filing any formal claim, you agree to contact us to seek an informal resolution of the dispute.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GPS Live Navigate regarding the Platform.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
